Welcome to Outlaws & Gents

These Terms of Service ("Terms") govern your use of the Outlaws & Gents Grooming Co. website at www.outlawsandgents.com (the "Site") and any products, services, content, or features we offer through the Site (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

"Outlaws & Gents," "we," "us," and "our" refer to Outlaws & Gents Grooming Co. and its affiliates. "You" and "your" refer to you, the person using the Site.

1. Eligibility

To use the Services, you must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and able to enter into a legally binding contract. If you are using the Services on behalf of an organization (for example, a barbershop or retail buyer), you represent that you have the authority to bind that organization to these Terms.

We do not knowingly market to or accept orders from minors. See our Privacy Policy for our policies regarding children and personal information.

2. Your Account

You may need to create an account to access certain features (for example, to place orders, manage your profile, or access wholesale pricing). When you create an account, you agree to:

Provide accurate, current, and complete information
Keep your password confidential
Notify us promptly at orders@outlawsandgents.com of any unauthorized use of your account
Accept responsibility for all activity that occurs under your account

We reserve the right to suspend, terminate, or refuse access to any account at our sole discretion, including for violations of these Terms or for behavior we determine to be fraudulent, abusive, or harmful.

3. Orders, Pricing, and Payment

3.1 Placing an order

By placing an order through the Site, you make an offer to purchase the products you've selected at the prices shown. Your order is not accepted until we send an order confirmation email. We may decline or cancel any order for any reason, including suspected fraud, product unavailability, or pricing errors. If we cancel an order you've paid for, we'll refund you in full.

3.2 Prices and taxes

All prices on the Site are in U.S. dollars and do not include shipping or applicable sales tax. We collect sales tax in jurisdictions where required by law. We may change prices at any time without notice, but changes will not affect orders we've already accepted.

3.3 Payment

We accept the payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the payment method and authorize us (and our payment processors) to charge the full order amount.

3.4 Pricing errors

We make every effort to display accurate prices. If we discover a pricing error after you've placed an order, we'll contact you to confirm whether you want to proceed at the corrected price or cancel for a full refund.

4. Shipping and Delivery

Shipping options, costs, and delivery estimates are described in our Shipping Policy, which is incorporated into these Terms by reference. Title and risk of loss for products pass to you when we deliver them to the carrier.

5. Returns and Refunds

Our return and refund process — including our 30-day satisfaction guarantee — is described in our Refund Policy, which is incorporated into these Terms by reference.

6. Product Information, Use, and Safety

6.1 Product information

We work hard to display product information, photographs, ingredient lists, and descriptions accurately. Colors and packaging may vary slightly from what you see on screen. Ingredient lists and product specifications may be updated from time to time as we improve our formulations; the current information on the Site at the time of your purchase governs your order.

6.2 Cosmetic use only — not a drug or medical device

Our products are intended for external personal grooming use only. They are cosmetic products as defined under U.S. FDA regulations and are not drugs, medical devices, or treatments. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Statements about product performance describe cosmetic effects only.

6.3 Ingredients — natural and synthetic

Our products contain a combination of natural and synthetic ingredients selected for performance. Natural ingredients include (but are not limited to) essential oils, plant-derived butters and waxes (shea, mango, hemp seed, beeswax, candelilla, carnauba), and nut-derived oils (argan, sweet almond, meadowfoam seed). Synthetic ingredients include the modern fixatives used in our styling products. The full ingredient list for each product is published on its product page and on the product packaging. Ingredient formulations may be updated from time to time; the list at the time of your purchase governs.

6.4 Allergens and skin sensitivities

Any cosmetic ingredient — natural or synthetic — can cause an allergic reaction or skin sensitivity in some individuals. This includes ingredients widely regarded as safe and gentle. You are responsible for reviewing the ingredient list for each product before use, particularly if you have:

Known allergies to any listed ingredient (especially tree nut, seed, or essential oil allergies)
A history of dermatitis, eczema, rosacea, or other skin conditions
Recently broken, irritated, sunburned, or post-procedure skin
Sensitive skin
Pregnancy or active breastfeeding (some essential oils are not recommended)

6.5 Patch test required before first use

Before first use of any product, we strongly recommend conducting a patch test:

Apply a small amount to the inside of your forearm or behind your ear
Leave for 24 hours and avoid washing the area
Check for redness, itching, burning, swelling, or other irritation

If any reaction occurs during or after the patch test period, do not use the product.

6.6 Discontinue use if you experience an adverse reaction

Discontinue use immediately if you experience irritation, redness, rash, itching, burning, swelling, blistering, breathing difficulty, dizziness, or any other adverse reaction. If symptoms persist, worsen, or are severe, seek medical attention without delay from a licensed healthcare professional.

6.7 Use at your own risk — no warranty of suitability for any individual

Skin chemistry, sensitivities, and reactions vary between individuals. We make NO representation or warranty that any product is suitable for any particular individual or that you will not experience an adverse reaction. You assume all risks associated with the use of our products. This use-at-your-own-risk acknowledgment is in addition to (not a limitation of) the disclaimer of warranties and limitation of liability in Sections 11 and 12.

6.8 Specific cautions — fully healed skin only

Apply to fully healed skin only. NEVER apply any Outlaws & Gents product to skin that has scabs, cuts, open wounds, scaling, flaking, active acne, recent shaving irritation, or any other indication that the skin is not fully healed. Fully healed skin only — no exceptions.
Tattoos: Do not apply our products to fresh tattoos, healing tattoos, scabbed tattoos, flaking tattoos, peeling tattoos, or tattoos at any stage of the healing process. Use only on tattoos that are completely and fully healed. Follow your tattoo artist's specific aftercare instructions for fresh tattoos. If you are unsure whether your tattoo is fully healed, do not use our products. Consult your tattoo artist or a dermatologist.
Hair products: Avoid contact with eyes. If contact occurs, rinse thoroughly with water.
All products: For external use only. Avoid contact with eyes, mouth, and other mucous membranes.

6.9 Children

Our products are formulated for adult use. Keep out of reach of children. If accidentally ingested, contact your local Poison Control Center immediately. In the United States, call 1-800-222-1222.

6.10 Not medical advice

Nothing on our Site, in our packaging, or in our marketing constitutes medical, dermatological, or health advice. If you have a medical concern, skin condition, allergy, or any question about whether our products are appropriate for you, consult a licensed healthcare professional or dermatologist before use. Our products and content are not a substitute for professional medical advice, diagnosis, or treatment.

7. Intellectual Property

The Site and all content on it — including text, graphics, images, photographs, logos, product names, formulations, articles, videos, and software — are owned by Outlaws & Gents or our licensors and are protected by U.S. and international copyright, trademark, trade dress, and other intellectual property laws.

You may view, download, and print Site content for personal, non-commercial use. You may not:

Copy, reproduce, modify, distribute, sell, or commercially exploit any Site content without our prior written consent
Use our trademarks, logos, or brand assets without permission
Use automated tools (bots, scrapers, crawlers) to harvest content from the Site beyond what's permitted in our /robots.txt file
Use the Site or its content to train artificial intelligence or machine learning models without our prior written consent

8. User Content

If you submit reviews, comments, photos, social tags, or any other content to or through the Site ("User Content"), you grant us a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, display, and create derivative works from your User Content for any business purpose, including marketing and advertising.

You represent and warrant that:

You own or have the necessary rights to your User Content
Your User Content does not infringe any third-party rights (including copyright, trademark, privacy, or publicity rights)
Your User Content is truthful and does not violate any law
You're at least 18 years old

We reserve the right (but have no obligation) to monitor, edit, or remove User Content at our sole discretion. We are not responsible for User Content posted by others.

9. Prohibited Conduct

You agree not to:

Use the Site for any unlawful purpose or in violation of any applicable law
Post or transmit content that is false, misleading, defamatory, harassing, threatening, obscene, hateful, or otherwise objectionable
Impersonate any person or entity, including any Outlaws & Gents employee or representative
Interfere with or disrupt the Site, its servers, or the networks connected to the Site
Attempt to gain unauthorized access to any part of the Site, other users' accounts, or our systems
Upload viruses, malware, or any other malicious code
Use the Site or its content to train AI or machine learning models without our prior written consent
Collect or harvest personal information about other users
Use the Site to send unsolicited communications (spam)
Reverse-engineer, decompile, or attempt to derive source code from any part of the Site
Resell our products without authorization (commercial resale requires a wholesale account in good standing)

We may report suspected unlawful activity to law enforcement and cooperate with investigations.

10. Third-Party Links and Services

The Site may contain links to third-party websites, services, and resources (for example, payment processors, shipping carriers, partner sites). We do not control these third parties and are not responsible for their content, products, services, or privacy practices. Your interactions with third parties are solely between you and them.

11. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the results obtained from using the Services will meet your expectations.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the disclaimers above apply to the maximum extent permitted by law.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL OUTLAWS & GENTS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION) ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Outlaws & Gents, its affiliates, and its officers, directors, employees, agents, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Your use of the Services
Your violation of these Terms
Your violation of any third-party rights (including intellectual property, privacy, or publicity)
Your User Content

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you'll cooperate with us in asserting available defenses.

14. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

14.1 Informal resolution first

Before filing any formal claim, you agree to first try to resolve the dispute informally by contacting us at orders@outlawsandgents.com. We'll work in good faith to resolve the issue within 60 days.

14.2 Binding arbitration

If we can't resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be resolved by binding individual arbitration administered by JAMS under its Comprehensive Arbitration Rules and Procedures (or, for claims under $250,000, its Streamlined Arbitration Rules). The arbitration will be conducted in San Antonio, Texas, or by video conference at the arbitrator's discretion.

14.3 Class action waiver

You and Outlaws & Gents agree that any arbitration or proceeding will be limited to the dispute between us individually. To the fullest extent permitted by law, no arbitration or proceeding will be joined or consolidated with another, and there is no right or authority for any dispute to be arbitrated or litigated on a class-action basis or to use class action procedures.

14.4 Exceptions

Notwithstanding the above, either party may bring a claim in small claims court for disputes within that court's jurisdiction, and either party may seek injunctive or other equitable relief in court to protect its intellectual property rights.

14.5 Opt-out

You may opt out of this arbitration agreement by sending written notice to orders@outlawsandgents.com within 30 days of first accepting these Terms. The notice must include your full name, mailing address, email, and a clear statement that you wish to opt out of arbitration.

15. Governing Law and Venue

These Terms and any dispute arising from or relating to them or the Services are governed by the laws of the State of Texas, without regard to its conflicts of law provisions. To the extent litigation is permitted under Section 14 (for example, small claims or equitable relief), the exclusive venue is the state and federal courts located in Bexar County, Texas, and you consent to the personal jurisdiction of those courts.

16. Modifications to the Terms

We may update these Terms from time to time. When we do, we'll post the updated Terms on this page and update the "Last updated" date at the top. For material changes, we'll provide additional notice (for example, by email or a Site banner) where required by law. Your continued use of the Services after the updated Terms take effect constitutes acceptance of the changes. If you don't agree to the updated Terms, stop using the Services.

17. General Provisions

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of that or any other provision.

Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms freely (for example, in connection with a merger, acquisition, or sale of assets).

Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control (including acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, supply chain disruption, or government action).

Entire agreement. These Terms, together with the Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and Outlaws & Gents regarding the Services and supersede any prior agreements.

Headings. Section headings are for convenience only and do not affect interpretation.
